Client’s Bill of Rights
As a client of Morro Bay Recovery, a drug and alcohol rehabilitation center in the state of California, you are entitled to the following rights, as mandated by California Health and Safety Code (HSC) Sections 11857, 11857.1, 11857.2, 11857.3, 11857.4, 11857.5, 11831.7, and Behavioral Health Information Notice (BHIN) 23-045. These rights are designed to ensure that you receive respectful, ethical, and client-centered care during your treatment.
1. Right to Respectful Treatment
- You have the right to receive considerate, respectful, and dignified care at all times.
- You have the right to care that is free from discrimination or harassment based on race, color, religion, national origin, age, gender, gender identity, sexual orientation, disability, or any other characteristic protected by law.
- You have the right to be treated with compassion and without judgment, fostering a supportive and understanding therapeutic environment.
2. Right to Privacy and Confidentiality
- You have the right to privacy regarding your personal and medical information.
- All communications and records pertaining to your care and treatment will be kept confidential, except as required or permitted by law.
- You have the right to be informed of circumstances where confidentiality may be breached and provided with an explanation of those legal requirements.
3. Right to Informed Consent
- You have the right to be fully informed about your treatment options, including potential benefits, risks, and alternatives.
- You have the right to consent to or refuse treatment at any time, unless otherwise mandated by law or deemed a medical necessity for your safety.
- You have the right to receive a clear and comprehensive explanation of your treatment plan.
4. Right to Participate in Treatment Planning
- You have the right to be actively involved in developing, reviewing, and modifying your individualized treatment plan.

9. Right to Cultural and Religious Considerations
- You have the right to receive care that respects your cultural, spiritual, and religious beliefs and practices.

10. Right to Transparent Policies
- You have the right to be informed about the facility’s policies, including discharge and referral policies, in a clear and understandable manner.

treatment and care.
11. Right to Safe and Ethical Treatment Practices
- You have the right to receive treatment from qualified and licensed professionals.
- You have the right to care that adheres to ethical and professional standards established by state and federal laws.
- You have the right to receive evidence-based treatment services that prioritize your safety and well-being.
12. Right to Prohibitions Against Unethical Practices
You have the right to be protected from any form of unethical treatment, including but not limited to:
- Misrepresentation of services.
- Coercion or undue influence to participate in treatment programs.
- Exploitation of any kind, including financial or emotional.
13. Section 11857.3 Prohibitions
Section 11857.3 prohibits:
- Misleading advertising or promotion of services.
- Financial arrangements or kickbacks that exploit clients.
- Any form of patient brokering or undue influence to enroll in a specific facility.
- Coercion or threats to continue treatment against the client’s will.
14. Right to Terminate Treatment
- You have the right to discontinue treatment at any time, subject to applicable discharge policies and procedures.
- You have the right to receive information about the potential consequences of discontinuing treatment.
- You have the right to receive referrals or assistance in accessing alternative services if you choose to terminate treatment.
